FRAZIER FIREARMS LLC DOES NOT ENDORSE, SUPPORT, WARRANT, OR GUARANTEE THE COMPLETENESS, TRUTHFULNESS, ACCURACY, OR RELIABILITY OF ANY CONTENT POSTED TO OR THROUGH THESE SITES OR ENDORSE ANY OPINIONS, PRODUCTS, OR SERVICES OFFERED OR PROVIDED BY OR ON BEHALF OF THE THIRD PARTIES ON OR THROUGH THESE SITES. FRAZIER FIREARMS LLC IS NOT A PARTY TO AND DOES NOT MONITOR ANY TRANSACTION BETWEEN USERS AND THIRD PARTIES WITHOUT THE DIRECT INVOLVEMENT OF FRAZIER FIREARMS LLC

You expressly warrant and agree that any material downloaded or otherwise obtained through the use of this Site is done at your own discretion and risk and that you will be solely responsible for any damage to your computer system or network or any loss of data that results from the download of any such material.

In addition to agreeing to comply with all applicable laws, you agree you will not use any such Content or Marks from this Site for any purpose without the appropriate prior written authorization.

C. General Firearm Sales

All firearms, magazines, receivers, and restricted law enforcement items are sold in accordance with all existing federal, state, and local laws and regulations. Many of the firearms, magazines, and parts for sale on this website may be restricted or prohibited in your area. It is the buyer’s responsibility to check your local and state regulations before ordering. By purchasing a firearm, you certify that you will abide by the following safety rules:

You are not prohibited by Federal or State law or local ordinance from receiving firearms or ammunition.
You are at least 18 years of age if purchasing any long guns or long gun ammunition.
You are at least 21 years of age if purchasing a handgun or an ATF-defined “Other” firearm or ammunition for use in handguns.
You are the actual transferee/buyer of the firearm.
You are not under indictment in any court for a felony or any crime for which the judge could sentence you to over one year.
You have not been convicted of a felony in any court, or any crime, for which the judge could have sentenced you to more than one year, even if your sentence was shorter.
You are not a fugitive from justice.
You are not an unlawful user of or addicted to marijuana or any depressant, stimulant, narcotic drug, or any other controlled substance.
You have not been adjudicated mentally defective or have not been committed to a mental institution.
You have not been discharged from the armed forces under dishonorable conditions.
You are not subject to a court order restraining you from harassing, stalking, or threatening your child or an intimate partner or child of such partner.
You have not been convicted in any court of a misdemeanor crime of domestic violence.
You have never renounced your United States citizenship.
You are not an alien illegally in the United States.

D. Ammunition Purchases

You must be 18 or older to purchase rifle or shotgun ammunition. Always make sure to use the correct ammunition for your specific firearms. Check your local laws for any other regulations.

E. Limitations of Liability

YOU UNDERSTAND AND AGREE THAT FRAZIER FIREARMS LLC AND ITS SUPPLIERS WILL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR EXEMPLARY DAMAGES RESULTING FROM OR IN ANY WAY CONNECTED TO YOUR ACCESS TO, USE, OR INABILITY TO USE THE SITE OR CONTENT, OR FROM YOUR ACCESS TO, USE, INABILITY TO USE, OR RELIANCE UPON ANY LINKED WEBSITE, EVEN IF FRAZIER FIREARMS LLC OR ITS SUPPLIERS HAVE BEEN ADVISED OF THE POSSIBILITY OF THOSE DAMAGES. SOME JURISDICTIONS EITHER DO NOT ALLOW OR PLACE RESTRICTIONS UPON THE EXCLUSION OR LIMITATION OF DAMAGES IN CERTAIN TYPES OF AGREEMENTS; FOR THESE JURISDICTIONS, THE AFOREMENTIONED LIMITATION ON LIABILITY SHALL BE TO THE MAXIMUM DEGREE PERMITTED BY APPLICABLE LAW. IF, NOTWITHSTANDING THE ABOVE, LIABILITY IS IMPOSED UPON FRAZIER FIREARMS LLC, THEN YOU AGREE THAT FRAZIER FIREARMS LLC TOTAL LIABILITY FOR ANY OR ALL OF YOUR LOSSES OR INJURIES FROM FRAZIER FIREARMS LLC ACTS OR OMISSIONS, REGARDLESS OF THE NATURE OF THE LEGAL OR EQUITABLE CLAIM, SHALL NOT EXCEED $100.

F. Governing Law

These Terms and Conditions are governed by the laws of Ohio without regard to conflict of law provisions with the exception of the arbitration provision, which shall be governed by the Federal Arbitration Act. You hereby consent to the exclusive jurisdiction of the courts of the state of Ohio. The venue shall be in Columbus, Ohio.

G. User Responsibilities

You must be 18 years of age or older to provide information through these Sites. By using these Sites, you represent that you are at least 18 years of age. You shall be solely responsible for your own submissions and the consequences of posting or publishing them. You hereby grant to these Sites and its affiliates the worldwide, royalty-free, perpetual, irrevocable, non-exclusive right and license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, perform and display any message posted in the Community Areas.

You are solely responsible for reading and complying with any supplemental terms and/or rules, including, without limitation, those for any contests, sweepstakes, promotions, or other additional features made available on the Site.

By submitting your e-mail address in connection with the content you have submitted, such as rating and review, your Questions or Answer, you agree that Frazier Firearms LLC and its third-party service providers may use your e-mail address to contact you about the status of your review, Questions or Answers and other administrative purposes.

By submitting any content to Frazier Firearms LLC, you represent and warrant that:

you are the sole author and owner of the intellectual property rights thereto;
all "moral rights" that you may have in such content have been voluntarily waived by you;
all content that you post is accurate;

H. Conduct on the Site

By accessing the Site, you agree to the following rules of conduct. You or third parties acting on your behalf are not allowed to frame these Sites or use frames or utilize framing techniques or technology to enclose any content included on these Sites without Frazier Firearms LLCs' express written consent. Additionally, you may not utilize any site content in any meta tags or any other "hidden text" techniques or technologies without Frazier Firearms LLCs' express written consent. You agree and warrant that you shall not distribute, submit or publish any content:

that is known by you to be false, inaccurate, or misleading;
that infringes any third party's copyright, patent, trademark, trade secret, or other proprietary rights or rights of publicity or privacy;
that violates any law, statute, ordinance, or regulation (including, but not limited to, those governing export control, consumer protection, unfair competition, anti-discrimination or false
advertising); that is, or may reasonably be considered to be, illegal, obscene, sexually explicit, insulting, vulgar, defamatory, libelous, hateful, abusive, excessively violent, racially or religiously biased or offensive, unlawfully threatening or unlawfully harassing to any individual, partnership or corporation;

You agree to not abuse the variety of tools Frazier Firearms LLC provides for member interaction for the purpose of spamming users. We look for certain user behaviors to determine whether an account is spamming and will terminate the account of the abuser.

You agree to not impersonate any person or entity or falsely state or otherwise misrepresent yourself, your age, or your affiliation with any person or entity.

You understand the Site is available for your personal, non-commercial use only, and you agree not to use the Site for commercial activities or sales. Additionally, you may not ask members for help in the form of money, gifts, or donations.

You agree not to upload, post, transmit, share or otherwise make available unsolicited or unauthorized advertising. Pyramid schemes and cash gifting scams are illegal and posting information about these schemes anywhere on Frazier Firearms LLC sites is prohibited.

You agree to not use the Site in any unlawful manner or otherwise inconsistent with all applicable laws and regulations or in a manner that could damage, disable, overburden, or impair the Site.

You agree to not submit any content to the Frazier Firearms LLC Ratings and Reviews and the Customer Outdoor Answers for which you were compensated or granted any consideration by any third party or include any information that references other websites, addresses, e-mail addresses, contact information, or phone numbers.

You will not attempt to interfere in any way with Frazier Firearms LLCs' site networks or network security, or attempt to use these Sites to gain unauthorized access to any other computer system or attempt to post or transmit any information that constitutes a computer virus, worms or other potentially damaging computer programs or files.

You will not engage in conduct constituting or encouraging conduct that would constitute a criminal offense giving rise to civil liability or otherwise violate any city, state, national, or international law or regulation or which fails to comply with accepted Internet protocol.

Frazier Firearms LLC reserves the right to immediately terminate your account without further notice in the event that, in its judgment, you violate these Terms of Use and Community Guidelines. Accounts that are inactive for more than one year may be removed without further notice.

I. Security Rules

Violations of system or network security may result in civil or criminal liability. Frazier Firearms LLC will investigate occurrences and may involve, and cooperate with, law enforcement authorities in prosecuting the user or users who are involved in such violations. You are prohibited from violating or attempting to violate the security of the App, including, without limitation, the following:

Accessing data not intended for such user or logging into a server or account which user is not authorized to access;
Attempting to probe, scan or test the vulnerability of a system or network or to breach security or authentication measures without proper authorization;
Attempting to interfere with service to any user, host, or network, including, without limitation, via means of submitting a virus to Frazier Firearms LLC sites, overloading, " flooding", "mailbombing" or "crashing"; or sending unsolicited e-mail, including promotions and/or advertising of products or services;
Reverse engineering, reconstructing, copying, preparing derivative works, or otherwise imitating the App.
Forging any TCP/IP packet header or any part of the header information in any e-mail or newsgroup posting; or
Attempting to obtain information or account access from or about any user, host, or a network via any means including, without limitation, impersonation, false representations, "phishing" or "pharming" or misrepresentation.

J. Indemnity

You agree to defend, indemnify and hold Frazier Firearms LLC, its directors, officers, employees, agents, affiliates, joint ventures, and third-party service providers harmless from any and all claims, liabilities, damages, costs, and expenses, including reasonable attorneys' fees, in any way arising from, related to or in connection with your use of these Sites, your violation of the Terms or the posting or transmission of any materials on or through these Sites by you, including, but not limited to, any third party claim that any information or materials you provide infringe any third party proprietary right.

K. Entire Agreement

These Terms and Conditions, the Privacy Policy, and other policies Frazier Firearms LLC may post on this Site constitute the entire Agreement between Frazier Firearms LLC and you in connection with your use of this Site, any products or services offered on this Site, and the Content, and supersede any prior versions of the Terms and Conditions, if applicable. Frazier Firearms LLC may update these Terms and Conditions from time to time by posting revised Terms and Conditions on this Site, without notice to you, and your subsequent use of the Site is governed by those new Terms and Conditions. The Terms and Conditions are effective until terminated by Frazier Firearms LLC. In the event of termination, the proprietary rights, disclaimers, limitations of liabilities, and governing law provisions set forth in these terms and conditions will survive. In the event of a conflict between any other notice, policy, disclaimer, or other term contained in this Site, these Terms and Conditions will control. If any provision is deemed to be unlawful or unenforceable, it will not affect the validity and enforceability of the remaining provisions.
